FIFRA 12(a)(1)(E) To sell or distribute a pesticide that is misbranded. Specifically, the
registered pesticide product is being represented as an unregistered R&D product. All
unregistered pesticides being used for R&D purposes must list a brand name which does not
match that of a registered pesticide. Registered product labels must comply with labeling
requirements pursuant to 40 C.F.R. part 156.10.
