On April 26, 2021, Region 1 referred to DOJ a proposed cost recovery Settlement Agreement under CERCLA Section 122(h) for approval and signature at the Former Healy School Site in Fall River, Massachusetts. This proposed Settlement Agreement, which is based on ability-to-pay, requires the Settling Party, Spindle City Homes, Inc., to pay EPA its net sale proceeds from the sale of the property which is estimated to total $382,000. In exchange, EPA will release its lien and provide the Settling Party a covenant not to sue for the Site. This proposed settlement represents the Settling Party?s maximum amount of ability to pay.
