EPA Region 10 Settles with J.R. Simplot Company, Boise, ID for FIFRA Violations
On July 15, 2021, EPA Region 10 filed a consent agreement and final order resolving violations of the
Federal Insecticide, Fungicide, and Rodenticide Act by J.R. Simplot Company (Simplot) at its
Umatilla, Oregon and Mooreland, Idaho facilities. The Simplot facility in Umatilla, Oregon did not
have a sealed secondary containment where it conducted pesticide repackaging. The Simplot facility in
Mooreland, Idaho had leaking stationary pesticide tanks containing Vapam HL (EPA Reg. No. 5481-
468). Simplot had a total of seven violations of FIFRA Section 12(a)(2)(S) between the two facilities
pertaining to the above issues. The enforcement action ensures that pesticides will safely be repackaged
at both facilities and any potential spills can be contained before they contaminate the surrounding
environment. Simplot has agreed to pay a penalty of $ 65,248 and has returned to compliance.
