On July 15, Region 3 issued a FIFRA Notice of Warning (NOW) to Taminco US, LLC of Kingsport, TN for sale and distribution of misbranded pesticides imported through the Philadelphia International Airport. The pesticides were misbranded in that the label was missing an ingredient statement, a Keep Out of Reach of Children statement, hazard and precautionary statements, and a valid EPA Establishment number, as required by FIFRA. The pesticides were imported for research and development purposes and had been delivered to the end-use laboratory despite a Notice of Refusal of Admission (NORA) that was issued. The importer must provide a response to EPA explaining how they will ensure future import shipments are compliant with FIFRA. FIFRA violations are exempt from EJ screen. The Pennsylvania Department of Agriculture had been alerted to the NORA and EPA Region 4 was alerted of the NOW.
