This is a civil administrative penalty action brought against MIK Construction pursuant to Section 16(a) of the Toxics Substances Control Act for violations of Section 409 of TSCA by failing to comply with Section 402 of TSCA and its implementing regulations promulgated at 40 C.F.R. Part 745 Subpart E.
