On July 23, 2021, EPA filed an expedited settlement agreement (ESA) to simultaneously commence and conclude an enforcement action against Lincoln Manufacturing, Inc. of Lincoln, Rhode Island (Respondent). The ESA addresses alleged violations of Section 7(c) of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), 7 U.S.C. ' 136e involving the Respondent's failure to file annual pesticide production reports in connection with each registered establishment. The requirement for registered establishments to report production and sales information for pesticides and other pesticidal products/devices helps EPA carry out compliance, risk assessment and risk reduction functions important for protecting human health and the environment. Without annual production reports, EPA cannot determine where and in what manner pesticidal products are being produced, sold, and distributed. FIFRA Section 7 reporting requirements are enforced federally and are not delegated to the states. There are no known environmental justice issues associated with this action Lincoln Manufacturing will pay a penalty of $1400.
