Summary

On June 24, 2021, EPA Region 1 filed a combined complaint and consent agreement as an expedited settlement to simultaneously commence and conclude an enforcement action against Beaudry Enterprises, Inc. of Charleston, New Hampshire (Respondent) for alleged violations of Section 7(c) of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), 7 U.S.C. Sec. 136e. The agreement alleges that Respondent failed to file or timely file annual pesticide production report(s) in connection with each registered establishment. Allen Engineering agreed to pay a civil penalty of $1,400 to resolve the violation. The requirement for registered establishments to report production and sales information for pesticides and other pesticidal products/devices helps EPA carry out compliance, risk assessment and risk reduction functions important for protecting human health and the environment. Without annual production reports, EPA cannot determine where and in what manner pesticidal products are being produced, sold, and distributed. FIFRA Section 7 reporting requirements are enforced federally and not delegated to the states.
