EPA alleges that Respondent violated the terms of a NPDES Permit to which it was subject in violation of Section 402 of the CWA, 33 U.S.C. Section 1342 and discharged fill material into waters of the United States in violation of Section 404 of the CWA, 33 U.S.C. Section 1344.
