EPA conducted an inspection of the Facility on January 13-15, 2020, to determine Respondents compliance with Section 112(r) of the CAA, 42 USC 7412(r), and 40 CFR Part 68.Violations included: 68.12(d)(2) offsite consequence analyses, 68.67(e) Process Hazard Analysis, 68.69(c) failure to annually certify operating procedures, 68.71(b) failure to provide refresher training at least every three years, 68.71(c) failure to prepare training records, 68.73(d)(3) Mechanical Integrity Inspection and Testing, 68.79(d) failure to promptly determine and document an appropriate response to each of the findings of a compliance audit, and 68.95(a)(1)(ii) failure to maintain an emergency response plan with information on first-aid and emergency medical treatment to treat accidental human exposures.
