Summary

08/20/2021 - On July 7, 2021, EPA filed a Consent Agreement and Final Order (CAFO) against Robert Thibault resolving Toxic Substances Control Act (TSCA) claims for alleged violations of TSCA and the federal regulations promulgated thereunder, collectively referred to as the �Renovation, Repair and Painting Rule� or �RRP Rule.� Mr. Thibault is a contractor and sole proprietor who provides residential repair, renovation, and building services in and around the Burlington, Vermont area. In June 2020, Mr. Thibault performed an exterior renovation at a multi-family residential property located in Burlington, Vermont. Mr. Thibault failed to obtain EPA firm recertification, ensure that all individuals performing renovation activities are certified renovators and properly contain exterior work and close all doors and windows before beginning the renovation. The CAFO requires Mr. Thibault to pay a monetary penalty of $19,477 for the violations. This settlement is expected to encourage compliance in the regulated community with the Renovation, Repair and Painting Rule. The State of Vermont has been notified of this action. On March 4, 2021, EPA issues which SCAFO alleges that Respondent violated the RRP Rule during its renovation activities for compensation at the Property.
