In this action, EPA is proposing an Administrative Compliance Order under its authority pursuant to Section 1423 of the SDWA against Lee R and Glenda Smith & Sons Oil Co. (Respondent). The Proposed Administrative Order is requiring the Respondent to successfully demonstrate the mechanical integrity of the injection well, plug the well, or convert the well to production use. The injection well is known as Well No. 124D and is located on the Osage Mineral Reserve in Osage County, Oklahoma. Owners or operators of authorized by rule injection wells must comply with provisions at 40 C.F.R. ?? 147.2903, 147.2905, 147.2907 and 147.2910 through 147.2915.
