In this action, EPA is proposing an Administrative Compliance Order under its authority pursuant to Section 1423 of the SDWA against 4D Oil & Gas, LLC (Respondent). The Proposed Administrative Order alleges that the Respondent violated regulations at 40 C.F.R. ?? 147.2903(b), 147.2920(b), and Part I.B.1. of the permit by maintaining Well OS5718000 located in Osage County Oklahoma, in a manner that could allow the movement of fluid that contains contaminants into an underground source of drinking water and by failing to successfully demonstrate mechanical integrity.
