## Summary

On August, 25, 2021, EPA Region 6 issued  a Consent Agreement and Final Order (CAFO) under its authority pursuant to Section 16(a) of the Toxic Substances Control Act (TSCA) to ETC Texas Pipeline Ltd. for its Jal #3 Gas Plant in Jal, NM.  The CAFO was issued in response to a violation of Section 15(3)(B) of TSCA for failing to submit a report to EPA for sulfur during the 2016 Chemical Data Reporting submission period.  The CAFO requires ETC to correct the violation and pay a civil penalty of $23,460. The penalty must be paid within thirty days of the filing date of the CAFO.
