ALLEGED VIOLATIONS:
BASED ON INFORMATION RECEIVED IN RESPONSE TO AN INFORMATION REQUEST LETTER THE EPA MAILED ON JULY 11, 2019, TO THE RESPONDENT LOCATED AT 140 SOUTH SECOND STREET IN JESUP, GEORGIA, AND BASED ON INFORMATION GATHERED IN A JULY 27, 2020, SHOW CAUSE TELECONFERENCE WITH THE RESPONDENT, THE EPA ALLEGES THAT RESPONDENT VIOLATED SECTION 112 OF THE CAA, 42 U.S.C. ? 7412, AND 40 C.F.R. PART 61, SUBPART M. SPECIFICALLY, THE EPA ALLEGES THE RESPONDENT FAILED TO CONDUCT A THOROUGH INSPECTION FOR ASBESTOS-CONTAINING MATERIALS PRIOR TO BEGINNING RENOVATION ACTIVITY, AS REQUIRED BY 40 C.F.R. ? 61.145(A), OF A COMMERCIAL INSTALLATION WHICH THE RESPONDENT
OWNS CONSISTING OF ?THE STRAND CINEMA?, ?THE STRAND BISTRO?, AND AN ADJACENT BUILDING THAT WAS BEING RENOVATED INTO A PART OF THE NEW HISTORIC STRAND DINNER CINEMA LOCATED AT OR NEAR 169 WEST CHERRY STREET IN JESUP, GEORGIA, 31545 (THE FACILITY). THE RENOVATIONS BEGAN AT THE FACILITY ON OR AROUND OCTOBER 1, 2018.
