Summary

On September 8, 2021, EPA issued a Clean Water Act administrative order to the City of Amesbury, Massachusetts to require the elimination of Sanitary Sewer Overflows (SSOs) and to address violations of the General Permit for Stormwater Discharges from Small Municipal Separate Storm Sewer Systems (MS4s) in Massachusetts. Amesbury owns and operates a wastewater treatment facility, a wastewater collection system for the conveyance of sanitary sewage, and an MS4 for the conveyance of stormwater. An EPA audit identified recurring SSOs localized in one area with sewer capacity issues, as well as noncompliance with the MS4 Permit. The Order requires the City to submit a plan to eliminate the SSOs, followed by annual reports describing the City's progress in implementing the plan, and a final report upon the plan's completion. In addition, the City must take actions to fully comply with the MS4 Permit. The City does not contain any areas above the 80th percentile for any of the national EJ indices. EPA implements the Clean Water Act program in Massachusetts but coordinated with the Massachusetts Department of Environmental Protection on this matter.
