FIFRA 12(a)(1)(A) To sell or distribute to any person any pesticide that is not registered under
Section 3 or whose registration has been cancelled or suspended, except to the extent that
distribution or sale otherwise has been authorized by the Administrator under FIFRA. Specifically,
the consignee has provided documentation the ceramic filters, which have been treated with a silverbased antimicrobial preservative, are incorporated into a filter being sold with an EPA Registration
Number and an active ingredients statement listing silver as an active ingredient and marketing
materials with public health claims related to the silver-impregnated filters. These claims go beyond
what is permitted under the treated article exemption described under 40 CFR 152.25(a).
