EPA Region 10 Settles with Union Pacific Railroad Company, Mosier, OR for CWA Violations
On August 27th, 2021 , Region 10 filed a consent agreement and final order resolving violations of the Clean
Water Act (CWA) in Mosier, Oregon by Union Pacific Railroad Company. The railroad company
discharged approximately 47,000 gallons of Bakken crude oil, of which 30,000 gallons went to the
Mosier wastewater treatment plant (Mosier POTW) and 10 gallons discharged into the Columbia
River. As a result of the discharge, the Mosier POTW ceased operations and remained closed for
approximately two weeks. No oil was observed on the River after June 4, 2016, and there were no
observable impacts to fish or wildlife. The Respondent has agreed to pay a penalty of $30,000 to the
Oregon Department of Environmental Quality for the discharge violations and a penalty of $52,500 to
the Environmental Protection Agency for the pretreatment violations. In addition, Union Pacific
Railroad Company has returned to compliance.
