On September 15, 2021, EPA Region III filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative action proceeding against Fareva - Richmond, Inc. ( Fareva ) located at 2248 and 2300 Darbytown Road in Henrico, VA, 23231, for alleged violations of the Resource Conservation and Recovery Act ( RCRA ) and the authorized Virginia Hazardous Waste Management Regulations discovered after an inspection of the Facility on March 11 and 12, 2020. Fareva manufactures and packages over-the-counter health and beauty products at its facility. The alleged violations at the facility include: operating without a permit or interim status; failing to conduct a waste determination; failing to comply with uniform hazardous waste manifest record management requirements; failing to provide complete written job descriptions for positions related to hazardous waste management, failure to maintain and operate a facility to minimize the risk of a release of hazardous waste; failure to keep containers of hazardous waste closed, except when necessary to add or remove waste, and failing to conduct inspections of the hazardous waste accumulation area. The Facility is located in an area of potential EJ concern. Region 3 notified VADEQ, which had no objections to this action. Per the terms of the Consent Agreement, Fareva will pay a civil penalty in the amount of $25,120.00.
