9/20/2021 - CONSENT AGREEMENT AND FINAL ORDER ISSUED ASSESSING A PENALTY OF $12,100. PENALTY DUE WITHIN 30 DAYS.
ALLEGED VIOLATIONS:
BASED ON THE EPA?S OBSERVATIONS DURING THE RECORD REVIEW PERFORMED AFTER THE INSPECTION CONDUCTED ON OCTOBER 28, 2020, AT RESPONDENT?S OFFICE. THE EPA DETERMINED THAT, IN THE COURSE OF THE RENOVATION OF PROPERTIES SET FORTH IN PARAGRAPH 22, RESPONDENT FAILED TO:
A. PROVIDE THE OWNER OF THE UNIT WITH THE EPA-APPROVED LEAD HAZARD INFORMATION PAMPHLET IN VIOLATION OF 40 C.F.R. ? 745.84(A)(1);
B. RETAIN ALL RECORDS NECESSARY TO DEMONSTRATE COMPLIANCE WITH THE RESIDENTIAL PROPERTY RENOVATION FOR A PERIOD OF 3 YEARS FOLLOWING COMPLETION OF THE RENOVATION ACTIVITIES IN
VIOLATION OF 40 C.F.R. ? 745.86(A); AND
C. ENSURE THAT ALL INDIVIDUALS PERFORMING RENOVATION ACTIVITIES ON BEHALF OF THE FIRM ARE EITHER CERTIFIED RENOVATORS OR ARE TRAINED BY A CERTIFIED RENOVATOR IN VIOLATION OF 40 C.F.R. ? 745.89(D)(1).
