Kent Quality Foods, Inc. (Kent), Hudsonville, Michigan violated 40 C.F.R. Part 68: Chemical Accident Prevention Provisions of the Clean Air Act. Kent owns and operates an ammonia refrigeration system at its facility in Hudsonville, Michigan.
Specifically, Kent failed to document, address, establish, and implement several elements of its RMP program associated with management, process hazard analysis, operating procedures, training, mechanical integrity, management of change, hot work permit, contractors, and emergency response. During settlement negotiations, Kent installed and commissioned an industrial alarm notification software system to monitor the ammonia refrigeration system and provide notification to Kent personnel of any alarm, developed and updated Standard Operating Procedures for missing elements, and identified Kent employees for ammonia operator training and certification. There is a concurrent Administrative Consent Order associated with this CAFO.
This Consent Agreement and Final Order requires Kent to pay a penalty of $87,261 and resolves the FOV issued to Kent on March 31, 2020.
