On September 24, 2021 EPA Region III filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative action proceeding against Silgan White Cap ( Silgan ) located at 350 Jaycee Drive in Hazelton, PA ( Facility ) for alleged violations of the Resource Conservation and Recovery Act ( RCRA ) and the authorized Pennsylvania Hazardous Waste Management Regulations discovered after an EPA inspection of the Facility on June 12, 2019. RCRA gives EPA the authority to control hazardous waste from the cradle-to-grave. This includes the generation, transportation, treatment, storage and disposal of hazardous waste. To that end, EPA develops regulations, guidance and policies that ensure the safe management and cleanup of solid and hazardous waste, and programs that encourage source reduction and beneficial reuse. Silgan is a global supplier of an extensive range of metal, plastic and composite vacuum holding closures to consumer goods packaging companies in the food and beverage. The violations in the settlement include operation without a hazardous waste permit, failure to properly manage equipment subject to Subpart BB, failing to properly label/date and keep closed containers of hazardous and satellite accumulation waste; and failing to properly manage universal waste. Region 3 notified PADEP, which had no objections to this action. Per the terms of the Consent Agreement, Silgan will pay a civil penalty in the amount of $38,970.00.
