Summary

On September 10, 2021, EPA Region 1 entered into a Consent Agreement and Final Order (CAFO) with Mike Bunie Inc. to settle alleged violations of the Lead Disclosure Rule, promulgated under the Residential Lead-Based Paint Hazard Reduction Act (Docket No. TSCA-01-2021-0083). The CAFO alleges that Respondent: (1) failed to provide all available records or reports pertaining to lead-based paint and/or lead-based paint hazards to a lessee before the lessee entered a lease contract to rent an apartment; and (2) failed to attach or include a complete list of the available records in the lease contract. The building was under contract for lead abatement at the time of the violations. One of the incoming tenants was pregnant and had a young child. Respondent failed to provide all available records, including an elevated blood lead level notice of a child formerly residing at the building, and a state order requiring that no unabated apartment be re-leased. Respondent, who owns multiple rental buildings in and around Manchester, NH, will pay a penalty of $15,684. By encouraging regulatory compliance, the settlement will help to ensure that potential lessees are able to take into consideration the existence of lead-based paint and lead-based paint hazards in rental homes or apartments before renting the properties.
