Respondent is the owner of the affordable housing development property, known as Fortuna Wild Pineapple Subdivision. On December 15, 2020, an inspection at the Project revealed that land clearing and earth movement activities had taken place. On January 26, 2021, EPA issued a Request for Information letter to Respondent requesting information about the Project pursuant to Section 308(a) of the CWA, 33 U.S.C. ? 1318(a). Respondent failed to officially acknowledge receipt of the RFI Letter.
