On October 28, 2021, EPA Region 6 issued a Consent Agreement and Final Order (CAFO) under its authority pursuant to the Toxic Substances Control Act (TSCA) to Chevron Phillips Chemical Company LLC (CPChem) located in The Woodlands, TX and Port Arthur, TX. The CAFO was issued in response to alleged violations of Section 15(3)(B) of TSCA for failure to report Benzene for both the 2016 and 2020 Chemical Data Reporting periods, and for failure to report Benzene, 1,4-dichloro- for the 2016 Chemical Data reporting period.
The CAFO requires CPChem to pay a civil penalty of $70,359.00 within 30 days of the date of issue. The violations have been corrected.
