Summary

January 21, 2022 - PARTIAL CONSENT DECREE FOR REMEDIAL DESIGN AND REMEDIAL ACTION AT THE TRIANGLE PACIFIC SUPERFUND SITE ENTERED. NOVEMBER 11, 2021 - R4 Files Consent Decree with VIACOMBCBS, Armstrong World Industries, TCOM, and the U.S. Department of Defense for CERCLA violations. On November 11, 2021, Region 4 filed a proposed Consent Decree (CD) under Sections 106 and 107 of CERCLA with the U.S. District Court for the Eastern District of North Carolina for the implementation of the Interim Remedial Design (RD) / Remedial Action (RA), recovery of past costs, and recovery of future response costs at the Triangle Pacific (Site) in Elizabeth City, Pasquatank County, North Carolina. The Settling Defendants are Armstrong World Industries, Inc. (on behalf of Armstrong Wood Products, Inc.), VIACOMCBS, Inc., and TCOM, L.P. The Settling Federal Agency is the U.S. Department of Defense (DOD). A final RA will follow this Interim RD/RA to address any remaining groundwater contamination at the Site. Soil contamination is expected to be addressed completely by this action.
