On October 4, 2021, EPA issued a Notice of Violation and Administrative Order (NOV/AO) to New England Warehousing Group, LLC (NEWG) in West Haven, Connecticut for violating Clean Air Act (CAA) Section 112(r). NEWG is a regional trucking and warehousing company that handles and stores several chemicals reportable under EPCRA, some of which are also extremely hazardous substances covered by the CAA General Duty Clause (GDC) requirements. Among other findings, the NOV/AO alleges that NEWG failed to conduct a CAA GDC process hazard review to ensure safe operation of its warehouse. Under the NOV/AO, NEWG is placed on a schedule to come into compliance with GDC requirements. EPA's GDC program is not delegated to the state, however, EPA has communicated with the State of Connecticut and the West Haven Fire Department about this case and informed our federal partners at OSHA and the Department of Homeland Security. Based on a review of facility location data using EJSCREEN, the NEWG facility appears to be located in a potential environmental justice area due to several indicators falling above the 80th percentile.
