FIFRA 12(a)(1)(A) To sell or distribute a pesticide that is unregistered. Specifically, the R&D
pesticide is not labeled in accordance with 40 CFR 156.10 and so is not sold or distributed in
accordance with the provisions of 40 CFR 172.3. Therefore, the product is not exempt from
registration under any provision of 40 CFR 152.30 and is considered an unregistered pesticide.
