On November 5, 2021, EPA-Region III signed a Consent Agreement and Final Order with Harless Pit Stop, Inc. (Respondent), doing business as Pit Stop #2, for underground storage tank (UST) management violations of the regulatory requirements of the Resource Conservation and Recovery Act ( RCRA ). The agreement both initiated and resolved the matter. The Respondent is a retailer of petroleum products in Oceana, West Virginia. The violations involved failure to conduct tank release detection, failure to conduct annual functionality testing, failure to conduct annual line tightness testing or utilize a monthly method of piping release detection, and failure to have spill prevention equipment. Such violations can potentially lead to petroleum product leaks which can be harmful to both human health and the environment. The Consent Agreement and Final Order required the Respondent to certify that it is now in compliance and to pay a $1,000 penalty.
