Summary

On March 31, 2022, Region 10 filed a consent agreement and final order resolving Clean Water Act violations related to the Space Age Fuel, Inc.'s (Respondent) February 16, 2020 tanker truck roll over and oil spill that occurred on Highway 22, Milepost 63, approximately 8 miles east of Idanha, Oregon. The tanker truck roll over resulted in the discharge of approximately 7,871 gallons of gasoline and diesel fuel, some of which flowed into the North Santiam River and other fuels seeped into the river bank and soils undelying the roadway which continued fuel seeps into the river. The Respondent responded to the oil spill with river booming, vacuum trucks, water quality monitoring and the excavation and disposal of over 6000 tons of petroleum-contaminated soils. Spill response was conducted under a unified command that included on-scene coordinators from EPA and the Oregon Department of Environmental Quality (ODEQ). The North Santiam River is tributary to the Wilamette River which flows into the Columbia River. The North Santiam River is the drinking water source for multiple communities and it is an important fishery resource, supporting endangered and threatened steelhead and salmon species. The Respondent has agreed to pay a penalty of $135,000 under the EPA consent agreement final order. The Respondent is also entering into a settlement with ODEQ where it agreed to pay a $72,000 penalty and develop and implement an inclement weather safety program.
