Summary

On January 4, 2022, the Regional Judicial Officer issued a Final Order accepting the Expedited Settlement Agreement to settle RCRA violations and violations of Delaware underground storage tank (UST) management program regulations by SNEH Enterprises LLC, Tank Owner., and VIRU Enterprises LLC, Operator, of three USTs located at Summit Fuels UST Gas Station Mini Mart in Middletown, DE. Region 3's enforcement team, in coordination with DNREC, was able to resolve the UST violations of failing to properly conduct tank release detection on three USTs. The violations were discovered through information collected in response to an Off-site Compliance Monitoring (OfCM) Information Request Letter (IRL) sent by EPA on February 2, 2021. The respondents have agreed to pay a $2,820 penalty and have returned to compliance with the violations.
