On January 4, 2022, Region 3 filed an Administrative Order on Consent AOC ) with Hanover Foods Corporation which requires the Facility to correct violations of its NPDES Permit at its wastewater treatment facility ( WWTF ). The alleged violations included: (1) discharges of water exceeding Permit effluent discharge limitations; (2) floating solids and visible scum in wastewater and receiving water; (3) violations of the permit's operation and maintenance conditions, and (4) an unpermitted discharge of 6,500 gallons of brine in June 2018. In the AOC, Hanover agreed to (1) provide EPA with a complete engineering evaluation of the WWTF, of which must be completed by a certified Professional Engineer; (2) propose and implement a corrective action plan will achieve compliance milestones within the timeframes outlined in the AOC; (3) propose and implement a preventative maintenance plan covering the WWTP's primary treatment, secondary treatment, disinfection process, solids handling, and/or other equipment critical for optimal plant operation. EPA has consulted with PADEP during the development of this action. Hanover Foods Corporation is not located within an EJ area.
