On October 21, 2021, EPA Region 6 issued a CAFO under its authority pursuant to RCRA to Texas Electric Cooperative located Jasper TX. The CAFO was issued in response to violations of: 1) Failure to Comply with Standard Permit Conditions 2) Failure to Respond to Leaks and Spills 3) Failure to Properly the Clean Drip Pad Surface 4) Failure to make Adequate Hazardous Waste Determinations 5) Failure to Manage Containers 6) Failure to Maintain Required Records (Training Records) 7) Failure to Comply with the Manifest Requirements 8) Failure to Label Hazardous Waste Containers 9) Failure to Label Universal Waste. The CAFO requires TEC to 1) certify compliance 2) pay penalty of $137,024.86. TEC must respond to EPA Region 6 by thirty days by CAFO filing.
