On January 18, 2021, EPA Region III settled Clean Air Act (CAA) matter with Braskem America, Inc (Braskem) for the Braskem Marcus Hook Polymers facility located in Marcus Hook, Pennsylvania. After a Risk Management Program inspection by the Oil and Prevention Enforcement Section on November 5, 2019, EPA found that the Respondent had violated regulations implementing Section 112(r) of the CAA which requires chemical accident prevention planning at facilities that use certain hazardous substances. EPA found that the Respondent had violated regulations implementing Section 112(r) of the Act, specifically for failing to document that equipment complies with recognized and generally accepted good engineering practices with respect to process piping identification schemes and failing to label process piping. Braskem has agreed to pay a cash penalty of $1,500 as part of an Expedited Settlement Agreement and Final Order.
