Respondent sold five unregistered pesticides (Essential plus 1-0-1, SITKO SA 0-7-17, Recover RX 3-18-18, Green Speed Si 0-2-5, TKO Phosphite 0-0-26), sold two registered pesticides whose composition differed from their registrations (Companion Liquid Biological Fungicide 2-3-2 and Companion Biological Fungicide Wettable Powder) and failed to file annual production reports. They have agreed to pay a penalty of $437,000 and return to compliance with the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA).
