Respondent imported misbranded pesticide devices, Ozone Generators OG-301 & OG-302. The ozone generator labels included the phrase, ?It is a violation of Federal Law to use this product in a manner inconsistent with its labeling,? which is a misleading claim as it implies the pesticide devices have been reviewed by EPA or another federal agency. They have agreed to pay a penalty of $8,511, notify their customer of the misbranding violation, and return to compliance with the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA).
