Summary

February 3, 2022, EPA Region III filed a signed Consent Agreement and Final Order ( CAFO ) resolving an action against Heath Oil, Inc. for suspected violations of Section 311(b)(6)(B) and (j) of the Clean Water Act, in connection with its petroleum bulk storage facility in Harrisville, Pennsylvania. Specifically, EPA alleged that Respondent failed to: (1) amend the Facility's SPCC plan, (2) document the review and evaluation of the SPCC plan, (3) include information in the SPCC plan pertaining to the facility diagram and discharge response contact list, (4) include information in the SPCC plan pertaining major equipment failure, (5) conduct appropriate inspections, (6) conduct appropriate training, (7) provide adequate secondary containment, (8) conduct/record appropriate integrity testing, (9) follow the format of the model facility-specific response plan or prepare an equivalent response plan acceptable to the Regional Administrator to meet State or other Federal requirements, (10) develop a facility response training program to train those personnel involved in oil spill response activities, and (11) implement a drills and exercises program that follows the PREP Guidelines. The CAFO requires Respondent to pay $148,000.00 in civil penalties.
