Summary

On February 8, 2022, EPA Region III entered into a Consent Agreement with Adell Polymers, Inc. (Respondent) for violations of the toxic chemical release reporting requirements under Section 313 of EPCRA. An EPA investigation revealed that Respondent, a resins manufacturer located in Petersburg, WV, failed to submit a timely toxic chemical release inventory (TRI) report to EPA and to the State of West Virginia for trifluralin processed at its Petersburg, WV facility (the Facility) during each of calendar years 2017, 2018, and 2019 and for pendimethalin processed at the Facility during each of calendar years 2017 and 2019. EPCRA Section 313 requires facilities in specified industry sectors meeting certain toxic chemical manufacturing, processing and use thresholds to file TRI reports with EPA and the state for the preceding year. TRI reporting requirements were created to help communities plan for chemical emergencies. These reports inform the public about releases and other chemical waste management practices in their communities and provide the government with information for research and the development of appropriate regulations. Adell Polymers, Inc. has agreed to pay a $5,000 civil penalty for these violations, as based upon EPA's review and consideration of submitted financial information supporting the Respondent's claim that it is unable to pay the full penalty proposed by the Agency in this matter.
