During an inspection at the Drumm Lease near Rosalia, Kansas, which is owned and operated by Jim Snyder, Inc., EPA and Kansas Corporation Commission (?KCC?) officials observed a spill into De Haas Creek from a ruptured flow line and identified deficiencies in the lease?s Spill Prevention Control and Countermeasure Plan (?SPCC Plan?). A representative of Jim Snyder, Inc. responded to the spill, then, after meeting with a Region 7 compliance officer, corrected the SPCC Plan. The EPA has determined that Jim Snyder, Inc. is unable to pay a civil penalty and is now in compliance with applicable provisions of the Clean Water Act.
