On April 29, 2022, Region 10 filed an Expedited Settlement Agreement (ESA) resolving violations of the Clean Water Act by Border City Lodge (Facility) located in Tok, Alaska. On August 28, 2020, EPA responded to a spill from the Facility to nearby Desper Creek. In subsequent investigations, EPA found the Facility has an oil storage capacity of 38,800 gallons and lacked an SPCC plan. The SPCC program is centered around the prevention of oil spills from facilities with a total oil storage capacity over 1,320 gallons. EPA required the Border City Lodge to develop an SPCC plan; the preventative measures will help to prevent future releases from the Facility. The company agreed to pay a penalty of $1,750 for the SPCC violations. EPA estimates the Facility spent $6,500 to develop its SPCC plan.
