On March 14, 2022, EPA Region 1 filed a Consent Agreement and Final Order (CAFO) addressing U-Haul Co. of Western Massachusetts, Inc.'s alleged violations of the National Pollutant Discharge Elimination System General Permit for Discharges from Construction Activities (CGP) at the U-Haul Construction site in Lancaster, MA. On September 17, 2021, EPA conducted an inspection at U-Haul Construction and determined that the site did not have a CGP permit; additionally, the site was not properly stabilized and had inadequate perimeter controls during an August storm. Pursuant to the CAFO, U-Haul Co. of Western Massachusetts, Inc. will pay an $18,000 penalty. EPA implements the National Pollutant Discharge Elimination System program in Massachusetts. The case team worked closely with the Lancaster Conservation Commission and consulted with the Massachusetts Department of Environmental Protection on this matter.
