ALLEGED VIOLATIONS:
BASED ON THE EPA?S REVIEW OF RESPONDENT?S RECORDS PERFORMED DURING THE INVESTIGATION, THE EPA ALLEGES THAT IN THE COURSE OF THE RENOVATION OF PROPERTY A, RESPONDENT FAILED TO PROVIDE THE OWNER OF THE UNIT WITH THE EPA APPROVED LEAD HAZARD INFORMATION PAMPHLET IN VIOLATION OF 40 C.F.R. ? 745.84(A)(1). IN ADDITION, THE EPA ALLEGES THAT IN THE COURSE OF THE RENOVATION OF PROPERTY B, RESPONDENT:
(A) FAILED TO APPLY TO THE EPA AND OBTAIN FIRM CERTIFICATION TO PERFORM, OFFER OR CLAIM TO PERFORM RENOVATIONS OR DUST SAMPLING FOR COMPENSATION, IN VIOLATION OF 40 C.F.R.
?? 745.81(A)(2)(II) AND 745.89(A);
(B) FAILED TO ENSURE THAT ALL INDIVIDUALS PERFORMING RENOVATION ACTIVITIES ON BEHALF OF THE FIRM ARE EITHER CERTIFIED RENOVATORS OR ARE TRAINED BY A CERTIFIED RENOVATOR IN VIOLATION OF 40 C.F.R. ? 745.89(D)(1); AND
(C) FAILED TO RETAIN ALL RECORDS NECESSARY TO DEMONSTRATE COMPLIANCE WITH THE RESIDENTIAL PROPERTY RENOVATION FOR A PERIOD OF 3 YEARS FOLLOWING COMPLETION OF THE RENOVATION
ACTIVITIES IN VIOLATION OF 40 C.F.R. ? 745.86(A).
