On March 23, 2022, EPA issued an Administrative Compliance Order (Order) requiring Buffum's Auto Parts, LLC of Swanzey, New Hampshire to address discharges of stormwater associated with industrial activity without authorization of a National Pollutant Discharge Elimination System (NPDES) permit in violation of section 301(a) of the Clean Water Act. The company will either permanently cease the discharges or apply for coverage under the Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity within the time frames specified in the Order. The NPDES program has not been delegated to New Hampshire, but the New Hampshire Department of Environmental Services supports issuance of this Order.
