Region 3 and VADEQ lodge Consent Decree entered into with Frazier T. Boyd III and Boyd Farm, LLC for CWA 404 Violations in Eastern District of Virginia [United States, et. al v. Frazier T. Action No. ??] On [Date, 2025], DOJ lodged a Consent Decree in the U.S. District Court for the Western District of Virginia between Plaintiffs, EPA and VADEQ and Defendants Frazier T. Boyd III and Boyd Farm, LLC (?Defendants?) addressing violations of Section 301 and 404 of the Clean Water Act at three properties in Goochland and Louisa County, VA.  All three sites have unpermitted impacts to aquatic resources, including streams and wetlands, as a result of clearing and grubbing activities for new conversion at the sites which resulted in unauthorized discharges to waters of the United States, including dredge or fill material, without a permit.  The combined unpermitted impacts to these aquatic resources are approximately 17.43 acres of wetland and 2,919 linear feet of stream. Under the terms of the Consent Decree, Defendants agreed to pay a $450,000 penalty split between the United States and Virginia and requires the return to compliance for all three of the sites through injunctive relief in the form of restoration and compensatory mitigation for the impacted streams and wetlands. 

This matter was referred to EPA by the VADEQ, and Virginia joined EPA as a co-plaintiff to the Consent Decree with claims under the State Water Control Law.  The proposed Co
