On May 17, 2022, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act by Robert Yundt Homes, LLC, located in Wasilla, Alaska. Respondent discharged dredged and/or fill material into waters of the United States, including wetlands, without a Clean Water Act section 404 permit or authorization from the U.S. Army Corps of Engineers. The unauthorized discharges occurred at multiple locations in wetlands adjacent to Cottonwood Lake and Wasilla Lake, which included mechanical land clearing, placement of fill material, such as rip rap rock, soil, gravel, and woody debris for the construction of single-family homes and a backyard lawn area with a floating dock. Over one acre of wetlands and shoreline aquatic habitat for salmon, birds, and wildlife were directly impacted. This enforcement action serves as a deterrent against future violations of the Clean Water Act for the regulated community and the home builders association in the Matanuska-Susitna Borough. The Respondent agreed to pay a penalty of $29,500.
