On March 23, 2022, the Director of ECAD, Region 3, entered into an AOC with the Town of Selbyville ( Respondent ) for violations of its National Pollutant Discharge Elimination System ( NPDE ) Permit for Domestic Sewage, Permit No. DE0020010 ( the Permit ). Respondent is the owner and/or operator of its domestic sewage wastewater treatment plant (WWTP) located at 37619 Wastewater Lane, Selbyville, Delaware (the Facility ). The Facility discharges from its wastewater treatment plant into the Atlantic Ocean in the Delaware coast. Violations identified at the Facility include eight Permit exceedances of the daily maximum limits for biological oxygen demand (BOD) and Enterococci. Additionally, Respondent has had multiple operation and maintenance (O&M) violations. Respondent has agreed to complete an Engineering Evaluation of the WWTF grit removal system and update its SWP facility map to include and identify all facility buildings, secondary containment structures, stormwater inlets, conveyances, outfalls, and any other required information pursuant to Section 9.1.5.7.2.2. of the State of Delaware's Regulations Governing the Control of Water Pollution. Upon completion of the evaluation, the Respondent has agreed to make upgrades, repairs, or installation of a new grit removal system for WWTF.
