FIFRA ? 12(a)(1)(A): To sell or distribute to any person any pesticide that is not registered under
Section 3 or whose registration has been cancelled or suspended, except to the extent that
distribution or sale otherwise has been authorized by the Administrator under FIFRA. Pursuant
to FIFRA Section 17(a)(1), pesticides (even unregistered pesticides) intended for export may not
be misbranded. Specifically, the unregistered pesticide products must have certain label elements
such as an accurate ingredients statement and the phrase ?Not Registered for Use in the United
States of America.? The products in entry number 8MA-00008261 do not contain the required
label elements in accordance with Section 17 FIFRA and, therefore, are not in compliance.
