The AOC addresses unauthorized (unpermitted) dredged and fill material discharged to Snake Creek and adjacent wetlands in Midway, Utah, in violation of Section 404 of the Clean Water Act. The AOC requires the respondents to restore the portions of the creek and surrounding wetlands impacted by the unauthorized material. The U.S. Army Corps of Engineers, which referred this matter to EPA, found that at least 0.09 acre of wetlands and 135 linear feet of Snake Creek had been impacted at the site.
