On April 12, 2022, EPA issued a Notice of Violation and Administrative Order to Kate's Homemade Butter, Inc. for a violation of Section 112(r) of the Clean Air Act (CAA) at its butter manufacturing facility in Arundel, Maine. The Kate's Butter facility includes a refrigeration system that contains approximately 2,499 pounds of anhydrous ammonia and is located in a rural area with potential environmental justice concerns. The Administrative Order requires Kate's Butter to correct its noncompliance by completing a Process Hazard Review for its facility and providing related information to EPA. The company was provided an opportunity to enter into an order on consent but declined. Maine is not delegated to implement this program. However, State and local emergency response and planning personnel participated in EPA's inspection of the company.
