On August 17, 2022, EPA Region 10 entered into an administrative Consent Agreement and Final Order with PotlatchDeltic Land and Lumber, LLC (Potlatch) for violations of 40 CFR Part 63 Subpart DDDDD. PotlatchDeltic owns and operates a wood products facility on the Coeur dAlene Indian Reservation in St. Maries, Idaho (?St. Maries Complex or SMC), which is a major source of hazardous air pollutants (HAP). The SMC is subject to the National Emission Standards for Hazardous Air Pollutants (NESHAP) for Major Sources: Industrial, Commercial and Institutional Boilers and Process Heaters, 40 C.F.R. Part 63, Subpart DDDDD (NESHAP 5D). March 2019 stack testing showed that CO emissions triggered a requirement to conduct annual testing for CO under, 40 C.F.R. ? 63.7515(c) in 2020 and 2021. PotlatchDeltic did not conduct the annual testing required for CO until April 2022. Respondent agrees to pay a penalty of $84,547.
