Plasti-Paint, Inc. (Respondent) is the owner or operator of the facility at 316 Industrial Street DeWitt, Iowa 52742 (?Facility?). The EPA inspected the facility, on March 24, 2021. The EPA alleges that Respondent violated the following requirements of the RCRA hazardous waste management program.
a. 40 CFR 262.256(a) - Failure to provide description of arrangements made with local emergency agencies.
b. 40 CFR 262.262(b) - Failure to prepare a quick reference guide (QRG) and submit to emergency response agencies.
c. 40 CFR 262.17(a)(7)(v) - Failure to maintain training records on current personnel, which must be kept until closure of the facility. Training records on former employees must be kept for at least three years from the date the employee last worked at the facility.
d. 40 CFR 262.17(a)(7)(iii) - Failure to provide an annual review of initial hazardous waste training.
